The founder and manager of the firm, Counsel Alain Brophy (Quebec Bar Association – 2002), is a lawyer who has been in private practice for more than 20 years, mainly in business, corporate and environmental law. He acts as a corporate advisor for established companies in various fields, including the web, fisheries and seafood markets, marine transportation, wines and spirits.


Counsel Brophy holds a Master of Laws – Research Option (LL.M.) from the Université de Montréal (Honour List of the Faculty of Graduate Studies). He has extensive knowledge and published articles on environmental law, climate change and international trade. Information Collection

AB2.CA – LAW FIRM INC. collects personal information from clients when they engage the organization's services. Personal information may also be obtained from third parties in the context of services provided by the organization. The following personal information is generally collected by the organization:


  • Contact details: including name, title, position, employer, phone number, email address, and postal address.
  • Service-related information: including information provided or generated in the course of service delivery. This may include corporate, professional, and financial information, residence details, as well as other relevant business planning, estate planning, tax information, employee information including salaries and benefits, and information about clients and suppliers, as well as details on any type of dispute, personal or corporate, potential or actual, past, present, and future.
  • Public profiles: information made public, for example, on LinkedIn or any other website.
  • Communications: content from emails, voicemails, and other communications with the organization.
  • Background check information: including credit history, criminal record, economic sanctions, credentials, and other background information.
  • Device and browser information: during the use of the organization's website, including IP address, browser used, time zone, operating system, device type, hardware model, MAC address, and network information.


Usage

Personal information is primarily used to deliver services to clients, fulfill legal requirements, and manage, market, and enhance the organization's operations. The reasons for using personal information include, but are not limited to:

  • Customer service delivery.
  • Supplier management, including overseeing the services provided by third parties to the organization or its clients.
  • Compliance with laws and regulations, including checks on conflicts of interest, adherence to anti-money laundering laws, and record-keeping required by law or necessary to meet legal and regulatory obligations.
  • Management of the organization's website.

   

Sharing

Personal information may be shared in the context of the organization’s client mandates and services, in order to comply with legal requirements or to operate, market, and improve the organization’s activities. Personal information may particularly be shared with the following entities:

  • Clients: as part of providing services granted to clients where personal information is relevant for this purpose.
  • Verification service providers: who conduct checks regarding credit, sanctions, criminal activity, anti-money laundering efforts, and other background checks. 
  • Law enforcement and regulatory agencies: when required under applicable laws, including anti-money laundering declarations, or when we must report a legal violation.
  • Other third parties: as part of a business transaction involving the acquisition or transfer of part of a company.


Consent

With the required consent, whether explicit or implied, personal information can be collected, used, shared, or processed for several reasons including:

  •  Personal information within the scope of services provided to clients.
  • Processing of personal information with a third party who has the legally recognized right to handle this information.
  • When necessary, to conduct checks related to anti-money laundering or for other legal and compliance purposes, where permitted by law.
  • To respond to legal claims.
  • To conduct investigations.


Security

The physical, technical, and organizational security measures in place comply with legal service industry standards. These security measures aim to protect the confidentiality and integrity of personal information held by the organization. Unfortunately, no security system can fully guarantee the security and confidentiality of personal information. For highly sensitive information, specific file transfer methods may be used.


Location and Retention

Personal information is primarily stored in Canada. However, the organization may also use service providers in the United States and globally, except where restricted by legal or contractual requirements. Laws in other countries may not be as restrictive as those in Canada, and personal information held outside Canada may be disclosed to governments, courts, or law enforcement or regulatory agencies of those other countries in accordance with their laws.

   

Information is kept as long as necessary to fulfill the purposes for which it was collected. Personal data is also retained to comply with obligations under applicable laws and regulatory requirements, and to maintain records for potential legal actions or investigations. The retention period varies depending on the nature of the information held, extending up to 10 years. Additionally, copies of personal data stored in electronic backups may be retained until they are destroyed in the ordinary lifecycle of these backups.


Children and Minors

The organization does not knowingly collect personal information from children or individuals under 14, except as part of a client engagement (e.g., preparing tax returns, estate planning, and other legitimate purposes).


Cookies

The organization's web service providers use cookies, spy pixels, and similar technologies.   • Correction: The right to request corrections to any incomplete or inaccurate personal information. The organization may refuse to correct personal information in certain cases as provided by applicable law. Anyone wishing to exercise this right can send a written request to the Privacy Protection Officer at the contact details provided below.


  • Withdrawal of Consent: The right to request to stop collecting, using, or sharing the personal information held. The organization may refuse to stop collecting, using, or sharing personal information in certain cases as provided by applicable law. Anyone wishing to exercise this right can send a written request to the Privacy Protection Officer at the contact details provided below.


  • Complaints: The right to file a complaint with the Privacy Protection Officer regarding compliance with this Policy. In the event of a complaint to the Office of the Privacy Commissioner of Canada or any other relevant authority, an investigation will be carried out in accordance with the law.
